I once fell out of status because I failed to maintained 12 units. I filed for reinstatement and it was approved after 2 miserable years. I had no idea why it took them that long but in those 2 years I felt my life was put on hold. Good news, yes they do approve if you file however you have to have a good reason in your letter to convince them to reinstate you. Goodluck

I am in a similar situation. My attorney says I could file.
Can i file for I-485 while my H1-B extension petition is pending?

Thanks for the info Morchu. I've just been concerned with the recent emails where USCIS seems to be ignoring the successor-in-interest clause. Also, I'll have to contact my attorney to see if re-filing of I-140 is required. It took 1 year for the first one - just frustrating to think how long it will take if the re-filing is required. I guess I don't have to worry about the retrogression for the 485 stage anytime soon!

Hi,
Can anyone tell me if its ok to mail my EAD & AP and spouse's EAD & AP renewals to be mailed in the same package to Texas? I can't find any posts regarding this.
The PO Box address for EAD is different from AP. But i think for non USPS carriers, there is only one address for Texas center (4141 N augustine rd).
So If I use this address can I mail all the 4 applications in the same package?
I am not trying to save money but feel that keeping all the apps together might help especially primary and secondary applicants...

According to the lawyer you can send it all in one big envelope and demarcate the I-131 vs the I-765 or do it like I am, in 2 seperate smaller envelopes and then I am going to put the 2 envelopes in the same fedex package and mail it out.

Consular Processing allows the beneficiary to remain abroad till the GC is approved at a consulate. At all times the petitioner should show intent to hire you for the future job. If you need to enter US earlier, it's your job to arrange an alternate visa.

I got my GC approved for me and son (I485 application) in Nov 2007. I got my gc, whereas for my son who is 7 year old though he got I485 approved yet he did not get his GC. They mentioned they might need his finger print and so far no response from them. This is despite several follow up with them.
Last year 7 months he was not in US and now can he go to India and he will be there rest of this year.
Will it affect his GC and when will he get his GC?

Thanks for the reply, I checked with the post office and they were unable to help, I have re-added my name to the mail box. but not sure whether its sent back. I will wait for couple of days more and call USCIS, Do i need to follow the same steps again, pay fees, file online??

IV is working to make politicians understand our EB relief issues.
The house blocked our EB reliefs for the past years, though there were so many good hearted politicians in both parties. What happended was that people like Lou Dobbs managed to convince certain "powerful" politicians to do nothing about CIR in the house.
I hope newly elected politicians do not get carried away by Lou and do resolve every issue that comes up to the fore.
Add my 2 cents, post office increased the postage to 39 cents long time back. ;)

My PD is 2006 under EB-2 category. My family and I filed for GC on the same day. Now, I am planning to file a new I-140 under EB1. My kid is going to be 18 soon. What is the age limit for dependent to file for GC with the parents?

Hello All - I understand from the website that the people already working in the US qualify for an emergency appointment if they are returning back to work in the US. Does anyone if this rule is also applicable it is the first time you are getting a H1-B visa stamp? I got a COS and am planning to get a stamp in December. I know that more dates are available now .. but was wondering if the need arises will I eligible for emergency appointment?

I have a pending I-140 with a Feb2004 PD which may or may not be approved and I have a Feb2005 PD with approved I-140. Which is a better stragety. Risk with the old PD and play safe and wait long for a GC?

My EB2 perm is approved now. Now, I am in dilemma to choose between EB2 and EB3. I can apply EB2 I 140 and I 485 concurrently (by assuming that they will port the PD) or I can apply I485 (for previously approved EB3). Please suggest as to what route I should take.

There are orgnizations that are opposed to this bill and are stronger than us. Only consistant efforts to make our voices heard would produce favorable results. We need letters comming from all members to these lawmakers so that when we lobby, these lawmakers already know that there are a lot of people who want this done and there is a broad support for such reforms.
