You say that you have the A# but do you also know the start and end date for the EAD? Your new employer needs to have all these to fill the I-9 form. What happens if I am in the 6th year of my H1, have the LC and I140, both approved from my current employer, and file for H1 extension while waiting on the retrogression...By all means, I will get the 3 year extension...
But, here's what is interesting I also have a concurrent H1 with another employer since the 5th year of my 6 year stay from the day I first entered on a H1. Assuming I have the LC and I140 approved on my 1st H1 and get the 3 year extension past the 6 years, can I get a similar 3 year extension on the concurrent H1?
Can anyone shed some light on it?

Congradulations again to all those IV memeber who are getting Green card approvals and goodluck to all those members who are able to file their I485 and get EAD, just to be out of H1B /H4 clutches and one more step closer to green card
As current drastic visa movment proved the fact that for IV members main issue is not current law but itz implimentation. a change in law will certainly help, but thatz not our big problem
I would like to discuss your IV future agend with current situation, Please post your opinion how you think IV should procede based on current situations.
I belive IV should now concentrate more on making sure current law is implimented in a more effeciant way, make sure USCIS does not waste any visa numbers, we need to push for speeding citizenship processes and makeup for loss time during retrogression

The preadjucation process is just like bringing a pregnant woman into labor but not allowing her to give birth till the babies number comes . The woman then needs to be painful labor for 28 years ( some member said that’s how long it will take ) , so the baby is grown and healthy ( preadjucated according to USCIS ) , but the doctors from the Department of state ( DOS ) are not allowing the baby to come out into the world .
USCIC is off late preadjucating the petitions and keeping them ready and many members seem to thrive on just seeing and discussing the LUD dates since by now most of us know somewhere in the subconsious that the GC is a nothing but a bone tied to our tail which we might never be able to bite .
Some members including me who unfortunately lack the analytical skills of some looked into a very interesting thread some time back which said EB2 will be current within a year . It spoke about 'spillovers' and we all were very happy that finally our baby will see the light of the day . Just like hope never dies I even though the dates have moved back to a date when most of us were in graduate college and the Clinton administration just left , some members are still now hopeful of a "spillover".
I for one have done what it takes for 4 long years in all ways possible to wake these guys up and now I am honestly least bothered about my GC and I feel the earlier members get to this level of mindset it will give them a lot of mental peace . I am just waiting for my visa to expire or my wall street employer to lay me off( whichever happens earlier ) in which case I also get a free ticket home .
The expectation that "next month may be the month" will surely kill you long before your GC actually gets cleared ( after 28 years ) .

hello, I am in a F1 status for about 3 years, I have been working and filing taxes. I am going to get married to a USC and apply for a green card through it. I want to know if I can have any problem in the aplication since I've been working without authorization.
Once you entered legally you should be able to get permanent residence even if you worked without authorization. thanks for your response. My lawyer said she mailed with Fedex and it was delivered 3 weeks back. She is saying these days it takes 3-4 weeks to get receipt notice. but I am not sure whether its true or its just my case getting lost somewhere.

I am on F1 visa. I enrolled in one of the university. I don't attend university in person. I do attend classes online from another state. My question is that I am resident of which state ?? Will I be automatically resident of state where exactly my university is ? I know it is mandatory to attend classes in person on F1. Can you please advise ? How is residency considered ?

If you are on F1, you need to be attending courses in-person - so e-learning/ distance learning is a voilation per-se of F1.
Now, if you were attending the courses in-person, you can be residing anywhere (particularly in cities close to state borders), and your residency will be the address where you are staying, not the university you are enrolled in. Hi All,
I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

some retaliations (for wistleblowers) based on race, ethnicity etc. are illegal. however if it was just because they didn't agree with your behavior or business related thoughts then they are perfectly okay firing you.
saying that usually the onus is on the company to prove that it was not because of any of the protected category (race, ethnicity etc.)

My efiled EAD went to TSC. I sent my copy of my approved I140 and I485 as supporting documents. I got my biometric notice in a weeks time and in a month I got my EAD card. But I guess you need not send any supporting docs because you can give your I485 and I140 number in the online application itself.

I dont think that the USCIS can staff all the Port of Entries with officers who are well versed in every single visa type.
It can hardly be expected that a typical POE officer is aware of all the requirements and intricasies of the H1B visa; LCA, prevaling wage, bench, client/employer, paystubs, client letter etc.
Nevertheless it is possible that there might be some POE officers placed at certain places (strategically ? ) in light of recent efforts to enforce H1B and DOL regulations more stringently; especially in light of the recent report highlighting the large amount of frauds and violations in the H1B program. In that case; one should still be fine if one has long term client project, all paystubs, tax returns etc.
Is there any way Immigration voice can find out if there has been a change of policy to enforce H1B regulations at the Port of Entry? (In addition to consular interviews and applying for the H1B itself)

If you have the valid H1b stamped while your 485 is pending and got RN,FP done,you should not have any issues in POE.So are you done with your FP?? Its always safe you wait for FP and finish it and then decide your travel plans.

I travelled after 485, got h1b stamping , came baack and recently my checks also got cashed and am looking for the Reciept Notice also.
I did not have any issues anywhere.
For FP - you just have to make sure someone is checking ur mailbox so that you will know when FP date comes, and you can postphone FP to a later date when you return

I have entered through JFK a week back. The officer was cordial..
Not sure whether the POE issues we have been hearing are resulting from any policy direction ..or just individuals acting on their own..
